This website is operated by Designify. Throughout the site, the terms “we,” “us,” and “our” refer to Designify. We provide this website, along with all the information, tools, and services available here, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices laid out here.

By visiting our site and/or purchasing something from us, you’re engaging in our Service and agreeing to be bound by the following Terms of Use (the “Terms”), including any additional terms, conditions, and policies we reference here or make available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and content contributors.

1. Platform Hosting and Security

Shopify Inc. provides the comprehensive e-commerce platform that enables us to securely offer our products and services to customers worldwide. By using our site, you acknowledge that certain aspects of security, data handling, and transaction processing are managed by Shopify and are subject to their terms and policies.

3. General Use of the Site and Offerings

  • Eligibility: To use our Offerings, you must be at least 18 years old or have parental consent.
  • Account Responsibility: Some Offerings may require an account. You are responsible for safeguarding your account information and agree to notify us immediately of any unauthorized access.

4. Products and Services

  • Digital Assets: Designify offers downloadable digital assets, including but not limited to mockup packs, designer lists, manufacturer lists, sound effects (SFX), and graphic effects (GFX) products. Each digital asset is licensed for individual use only and may not be redistributed, resold, or sublicensed without explicit permission from Designify.
  • Shopify Themes: Our Shopify themes are licensed for single-store use only. Redistribution, modification, or reselling of these themes without written consent from Designify is prohibited. For further details, refer to the full Theme License Agreement within our Legal section.
  • Custom Services: We offer custom services, including but not limited to website design, 2D and 3D logo design, and clothing design. All deliverables are subject to these Terms and any additional terms provided at the time of engagement.

5. Payments and Billing

  • Pricing: All prices are listed on the Site and are subject to change without notice. Prices do not include applicable taxes, which may be calculated based on your location.
  • Payment Terms: Full payment is required in advance for digital products and custom services. Additional fees may apply for project revisions or scope adjustments.

6. Intellectual Property

  • Ownership: All content on the Site, including digital products, themes, images, logos, and text, is the property of Designify. Purchase or use of our Offerings grants a license to use them under specified conditions; it does not transfer ownership.
  • User Submissions: Any content submitted by you, such as feedback, reviews, or suggestions, grants Designify a license to use it freely to improve our products, services, and communications.

7. Restrictions on Use

You agree not to:

  • Modify, distribute, or resell any of our Offerings without explicit written permission.
  • Use our Offerings for unlawful or unauthorized purposes.
  • Attempt to reverse-engineer or bypass any licensing systems embedded within our products.

8. Termination of Access

Designify reserves the right to suspend or terminate access to the Site and Offerings in the event of any violation of these Terms. In such cases, your license to use purchased Offerings will be revoked, and you must cease all usage immediately.

9. Disclaimers and Limitation of Liability

  • Disclaimer of Warranties: Designify provides all Offerings “as is” without warranties of any kind. We do not guarantee uninterrupted, error-free access to the Site or Offerings.
  • Limitation of Liability: To the fullest extent permitted by law, Designify shall not be liable for any indirect, incidental, or consequential damages arising from your use or inability to use the Site or Offerings.

10. Modifications to Terms

Designify reserves the right to update these Terms periodically. Significant changes will be communicated via the Site or email. Continued use of the Site or Offerings after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Site will be resolved exclusively in the courts of Dubai, United Arab Emirates.
